 When a Homeowner who lives in an Association wants to sell their home, the   Florida Statutes (720.401) require that there be ‘Disclosure prior to the sale of   the Residential Parcel’ and that a “Disclosure Summary” be provided to the   buyer before executing the sale.           As the Owner of the Property it is your responsibility to provide this unless you have the Title Company contact the Association(s) for you and then the Association(s) will provide this as part of the “estoppel” process.

The Title Company will request that the Association (s) respond with the following information:  When are association maintenance assessments due?  What is the balance on your account?  Who maintains the Association’s insurance?

   As provided by the Florida Statutes, if the seller does not provide the “Disclosure Summary” as required “to a prospective purchaser before the purchaser executes a contract for the sale of property governed by covenants that are subject to disclosure pursuant to this section, the purchaser may void thecontract by delivering to the seller or the seller's agent or representative written notice canceling the contract within 3 days after receipt of the disclosure summary or prior to closing, whichever occurs first….”
